All about the E2 Visa and franchises

The E2 is an investor visa available to nationals of countries that maintain a treaty of commerce and navigation with the United States. It allows the investor to live in the US to develop and manage a business. The spouse and unmarried children under 21 may be included, and the visa can be renewed indefinitely while the business remains active and meets the requirements.

The applicant must be a national of an E2 treaty country — such as Italy, Germany, Spain or Portugal, among roughly 80 countries — and must invest a substantial amount of capital in a US business that they will develop and manage.

The recommended minimum investment starts at US$ 100,000. The business cannot be marginal — it needs a real perspective of generating jobs and considerable profit.

It varies by consulate: consular processing usually takes around 3 to 6 months from submission to visa issuance — faster at some posts, longer at high-volume ones. Even so, the E2 remains one of the fastest paths for entrepreneurs to move to the United States.

A franchise offers a proven business model, which increases the chance of success — and of job creation and profit. The franchisor provides business documents to be attached to the visa application, and many franchises offer financial contingency: part or all of the investment may be refunded if the visa is denied, or the funds can be held in escrow under this condition.
